WaHa Vaporator® Pre-Order Terms and Conditions

Effective date: April 24, 2026

Thank you for your interest in pre-ordering a WaHa Vaporator® atmospheric water generator. These Pre-Order Terms and Conditions (“Terms”) form a binding agreement between you and WaHa Inc. (“WaHa,” “we,” or “us”). By submitting your pre-order and making the 20% deposit payment, you confirm that you have read, understood, and agree to these Terms in their entirety.

These Terms constitute the entire agreement between you and WaHa with respect to your pre-order and supersede any prior discussions, representations, or other agreements on this subject. No modification of these Terms is binding unless made in writing and signed by an authorized WaHa representative.

1. Products, Specifications, and Pricing

You may pre-order one or more of the following WaHa Vaporator® Oasis-24 units:

  • Oasis-24 Integrated Unit — $780 per unit deposit required. Presale per-unit price locked in at: $3,900 USD (40% off expected MSRP of $6,500) (plus taxes and shipping).
  • Oasis-24 Outdoor Unit — $600 per unit deposit required. Presale per-unit price locked in at $3,000 USD (40% off expected MSRP of $5,000) (plus taxes and shipping).

The product specifications in effect at the time of your order are published on our pre-order page at wahainc.com/o24-pre-order. A link to a copy of those specifications will be included in your order confirmation email for your records.

This pre-order locks in the current retail price only for the quantity ordered today. Any additional units ordered in the future will be priced at the retail price in effect at the time of that order.

If we make a material change to the published product specifications after you place your pre-order, we will notify you promptly and give you at least 30 days to cancel your order for a full refund of your deposit.

2. Payment Terms

The 20% deposit is collected immediately via Stripe and applied toward your final purchase price. The remaining 80% balance (plus shipping and any applicable taxes) will be due within 30 days of receiving your final invoice, which we will issue prior to delivery. You will receive a secure payment link at that time. All payments are processed through Stripe.

If you do not pay the remaining balance within 30 days of the invoice date, WaHa may cancel your order. We will send you a reminder before doing so and give you a reasonable opportunity to pay. If the order is cancelled for non-payment after a Production Commencement Notice has been issued for your unit (see Section 5), your deposit will be forfeited to offset costs already incurred. If the order is cancelled for non-payment before a Production Commencement Notice has been issued, your deposit will be refunded in full.

3. Delivery Timeline

Anticipated delivery is September 2027. This is an estimated date and is subject to change based on manufacturing schedules, supply chain conditions, regulatory approvals, and other factors outside our control. We will notify you of any material delays as soon as reasonably possible and provide an updated timeline.

4. Shipping

Shipping is not included in the retail price or deposit. Costs vary by destination, unit configuration, and carrier rates at the time of shipment. For reference, domestic U.S. delivery typically runs $150–$600 per unit; international freight varies significantly by destination. We will provide a shipping quote for your approval before issuing the final balance invoice. No shipping charge will be collected without your prior acknowledgment.

5. Cancellation and Refund Policy

Your 20% deposit is fully refundable if you cancel your pre-order at any time before WaHa issues a Production Commencement Notice for your unit(s). A Production Commencement Notice is a written notice from WaHa confirming that manufacturing of your specific unit(s) has begun.

We will give you at least 14 days’ advance written notice before issuing a Production Commencement Notice, giving you a final opportunity to cancel and receive a full refund.

Once a Production Commencement Notice has been issued, your deposit is non-refundable, as WaHa will have committed materials and production capacity to your order.

To cancel at any time before a Production Commencement Notice is issued, email sales@wahainc.com or contact your regional sales partner. Refunds will be processed back to the original payment method within 10 business days.

6. Changes to Your Order

You may increase the number of units at any time before your final invoice is issued. Any additional units ordered after this pre-order may be priced at the retail price in effect at the time of the additional order and are not subject to any previously locked pre-order pricing.

7. Risk of Loss and Title

Title and risk of loss pass to you upon delivery to the carrier. WaHa is not responsible for shipping delays or damage that occur after the unit leaves our facility. We recommend that you arrange appropriate shipping insurance for high-value international shipments; we are happy to assist with that coordination on request.

8. Limited Warranty

WaHa warrants each Vaporator® unit against defects in materials and workmanship for two (2) years from the date of delivery to the original purchaser.

What is covered: Manufacturing defects and component failures under normal operating conditions, as described in the product documentation provided at delivery.

What is not covered: Damage resulting from misuse, accident, unauthorized modification, failure to follow installation or maintenance instructions, use outside the specified operating envelope (7%–90% RH; −20°C to 52°C), normal wear on consumables (filters, membranes, and similar serviceable parts), or cosmetic damage that does not affect function.

Remedy: At WaHa’s option, we will repair or replace the defective unit or component at no charge. If repair or replacement is not practicable within 60 days of a valid warranty claim, we will refund the purchase price of the affected unit.

How to make a claim: Contact support@wahainc.com with your proof of purchase and a description of the defect. We will respond within 5 business days with next steps.

Implied warranties: To the fullest extent permitted by applicable law, WaHa makes no warranties beyond those expressly stated here. Some jurisdictions do not allow the exclusion of implied warranties; if yours is one of them, any implied warranties are limited in duration to the two-year period above.

9. Limitation of Liability

To the fullest extent permitted by applicable law, WaHa’s total liability to you for any claim arising under or related to these Terms shall not exceed the total amount you have paid to WaHa at the time the claim arises. In no event shall WaHa be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations; if yours is one of them, these limitations apply to the maximum extent permitted.

10. Force Majeure and Inability to Deliver

If WaHa is permanently unable to fulfill your order due to circumstances beyond its reasonable control, including natural disaster, war, government action, supply chain failure, or a cessation of WaHa’s business operations, WaHa will refund your deposit in full within 30 business days of determining that fulfillment is not possible. This refund is your sole remedy in such circumstances.

11. Dispute Resolution

If you have a concern about your order, please contact us first at sales@wahainc.com. We will make a genuine effort to resolve the matter informally within 30 days of receiving your notice.

If we are unable to resolve the dispute informally, both parties agree to submit it to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, administered in Santa Clara County, California. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. This does not prevent either party from seeking emergency injunctive relief in a court of law where necessary to prevent irreparable harm.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. For customers in Mexico, the UAE, the GCC, MENA, or other jurisdictions, mandatory local consumer protection laws may provide additional rights that are not waived by these Terms.
